Definitions and scope

The services on this website are provided by ETEJAH for Business Analysis and Development ("ETEJAH", "we"), based in Riyadh, Kingdom of Saudi Arabia. By using this website or contracting with us, you acknowledge that you have read and accepted this document.

These terms apply to every visitor of the website and every client who contracts with us, and are read together with the privacy policy, cookie policy and refund policy as a single set.

• Website: etejah.it.com and all of its sub-pages.
• Services: the business analysis, business development, feasibility study and management consulting services provided by ETEJAH.
• Client: any natural or legal person contracting with ETEJAH for a service.
• Scope of work: the document agreed between the parties defining deliverables, duration and fee.

Nature and limits of the services

ETEJAH's services are professional consulting services intended to support the client's decision-making. Our deliverables are built on the data and information the client provides and on market sources available at the time the study is prepared.

• Our deliverables are not a guarantee of profit, return or any specific financial outcome.
• Our deliverables are not certified legal, tax or accounting advice and do not replace consulting specialists in those fields.
• Our deliverables are not investment advice in the regulatory sense and are not subject to Capital Market Authority regulation.
• The final decision and its consequences remain with the client as owner and manager of the business.

Contracting, fees and tax

1. An engagement begins with a discovery session, followed by a technical and financial proposal defining scope, deliverables, duration and fee.
2. The proposal is deemed accepted upon signature, payment of the first instalment, or written approval through any documented electronic means.
3. All amounts are in Saudi riyals and exclusive of VAT, which is added at the statutory rate in force under the VAT Law and its Implementing Regulation.
4. The delivery period starts once all required data has been received and pauses whenever the client delays providing it.
5. Every scope of work includes two revision rounds within the agreed scope; any request beyond scope is estimated and priced as a separate addendum.

Client obligations

• Provide ETEJAH with correct and complete data and documents at the agreed time.
• Nominate an authorised representative to communicate, approve deliverables and attend review sessions.
• Pay the fee according to the agreed schedule.
• Not use the deliverables in any manner contrary to the regulations in force in the Kingdom.
• Confirm that documents submitted to us are owned by the client or that the client is authorised to use them.

Intellectual property

All elements of the website — logo, design, text, icons and code — are owned by or licensed to ETEJAH and protected under the Copyright Law of the Kingdom of Saudi Arabia.

• Ownership of the final deliverables specific to the client's project transfers to the client upon payment of the fee in full.
• ETEJAH retains ownership of its methodologies, templates, tools and internal models used to produce those deliverables.
• Copying, republishing or commercially exploiting website content without ETEJAH's prior written permission is prohibited.
• ETEJAH may refer to the engagement in general terms for reference purposes unless the client objects in writing.

Confidentiality

We treat as confidential every piece of information we access by virtue of the engagement, and we sign a non-disclosure agreement before receiving any data. This obligation survives the end of the engagement.

During the engagement we do not work with a direct competitor of the client in the same sector and geographic scope, unless the parties agree otherwise in writing.

Acceptable use of the website

The following are prohibited, and some may constitute a cyber offence under the Anti-Cyber Crime Law:

• Attempting unauthorised access to the website, its systems or its data.
• Using automated software to harvest content, overload servers or disrupt the service.
• Introducing malicious software or attempting to breach or disable any part of the website.
• Impersonating ETEJAH or its personnel, or submitting false information through the forms.

Disclaimer and limitation of liability

The website and its general content are provided "as is" for informational purposes. We do not warrant that it will be free of interruption or technical error, and we are not liable for any damage arising from inability to access it.

In all cases, ETEJAH's contractual liability shall not exceed the fee actually paid for the service subject to the claim, and we are not liable for indirect damages, lost profits or lost opportunities.

We are not liable for any breach caused by force majeure or circumstances beyond our control, including emergency regulatory decisions and interruption of communication services.

Third-party links and services

The website may contain links or embedded elements belonging to third parties such as map, font or social media services. Those services are outside our control; we are not responsible for their content or policies, and your use of them is governed by their own terms.

Amendment of these terms

ETEJAH may amend these terms at any time. Amendments are published on this page with an updated revision date, and your continued use of the website after publication constitutes acceptance of the amended version. Existing engagements remain governed by the terms in force at the time of contracting unless the parties agree otherwise in writing.

Governing law and dispute resolution

These terms are governed by and construed in accordance with the laws in force in the Kingdom of Saudi Arabia.

The parties shall seek to settle any dispute amicably within thirty days. Failing that, jurisdiction lies with the competent judicial authority in the city of Riyadh.
